Traffic Tickets

Traffic tickets are citations that result from traffic violations, those of which are usually separated into either a parking (non-moving) violation or a moving violation. A moving violation, which includes an infraction of a traffic law while the vehicle is in motion, is usually the more serious of the two.

Examples of a moving violation may include, but are not limited to speeding, failure to yield or failure to use a turn signal. Non-moving violations could include parking in a handicap spot without proper registration or parking at an unpaid meter.

Misdemeanor Traffic Violations

Based on the severity of the infraction, some traffic violations will be considered a misdemeanor under the law. These types of violations will in most cases bring harsher punishments such as suspension of an individual’s license, larger fines or possibly incarceration.

Violations that may constitute a misdemeanor charge include:

  • Reckless or dangerous driving
  • Driving under the influence of drugs or alcohol (DUI/DWI)
  • Hit and run
  • Driving without auto insurance
  • Driving without a drivers license

Traffic violations can also lead to more serious felony charges. Repeated DUI offenses may eventually lead to a felony charges, along with certain hit and run or vehicular homicide traffic violations.

Traffic infractions are technically considered criminal matters and may require the representation of an attorney in order to handle the mix of regulatory and criminal based on violations of state statues and city ordinances.
